Charl Groenewald is an expert franchise lawyer and skilled litigator who is well renowned for his skills pertaining to franchise litigation and resolving franchise disputes. As a recognised specialist in franchise and intellectual property law, Charl also represents MacRobert on the legal panel of FASA (the Franchise Association of South Africa) as well as the National Consumer Commission (NCC.). With more than twenty years of legal experience, Charl has represented various franchisors and franchisees of some of the most well-known franchise brands in South Africa and abroad.
The Consumer Protection Act (or ‘CPA’) created demanding prerequisites for franchising agreements, including prescribed terms and provisions for franchise disclosure documents, franchise renewal terms, marketing and franchise fees (or royalties) and exclusive franchise territories. Whereas franchisees are concerned with unfair franchise agreements, improper training, redundancy of the franchise brand and restraints of trade, the franchisors, on the other hand, seek to protect their intellectual property and franchise business system.
